Proposed DEP Watershed Permit Regulations

Nov 16, 2022 - MA DEP has issued draft regulations for watershed permitting, as well as draft Title 5 regulations.  Our understanding is that in nitrogen sensitive areas, all septic systems will need to convert their properties to a nitrogen-removing "innovative/alternative" septic system, unless the a watershed permit has been approved that commits the Town to public sewers or other technologies that will satisfy the nitrogen removals required for the individual watersheds.

It is believed that the following will be the future requirements for watersheds in Orleans:

Pleasant Bay Watershed – Watershed Permit approved, no I/A systems will be required.

 

Nauset Estuary Watershed – TMDL no yet issued.  I/A systems will be required within five years of a TMDL unless the Town submits an application for a Watershed Permit.

 

Rock Harbor Watershed - TMDL no yet issued.  I/A systems will be required within five years of a TMDL unless the Town submits an application for a Watershed Permit.

 

Namskaket and Little Namskaket Creek Watersheds – Not nitrogen sensitive.  I/A systems will not be required.

 

Atlantic Ocean Watershed area - Not nitrogen sensitive.  I/A systems will not be required.
